3 April 2015 at 11.00 am, representatives from UN security, Dr.Mukta Sharma, a technical officer of WHO in Thailand accepted the open letter requested the UN office to investigate over the violation of Ethiopian domestic worker's rights urged and recommendations for the protection of domestic workers.

Dr. Mukta spoke to representatives from Network for Domestic Workers in Thailand and Media that

‘’WHO is aware of allegations in the media about a private matter between a WHO employee in Thailand and an individual working at his residence. WHO is taking these allegations very seriously, and we are reviewing them according to WHO internal procedures’’

Regarding the question about "Immunities" Dr. Mukta stated that

"As international civil servants, some immunities are granted to WHO staff members to facilitate the proper exercise of their functions. However, these immunities can be waived by the Organization when they may impede the proper administration of justice, at the request of the government."

However, the employer of the Ethiopian domestic worker, Dr. Yonas Tengegn, issued a statement on 4 April 2015 and denied the claims. "These accusations made against me and my family are baseless. We deny any wrongdoing," he said in a statement. Read more reports from South China Morning Post

According to a report of Thai BBC on 1 April 2015, the Ethiopian domestic worker in the household of Dr. Yonas Tegegn, World Health Organization Representative to Thailand, has made serious allegations of exploitation and abuse against her employers. She has alleged that her wages had been withheld by her employers; that she was not given any holidays; that the housing given to her violated her dignity; that her passport had been seized; that she had been regularly subjected to physical assaults and that she was not given adequate food.

 These allegations relate to serious criminal offenses of deprivation of liberty, kidnapping, misappropriation, slavery and human trafficking.

 The case highlights the plight of around 300,000 domestic workers in Thailand. They include migrant domestic workers who are doubly vulnerable because of their limited skills in Thai language and limited access to human rights protection mechanisms.

 Even though the Thai government has made attempts to revise the law to provide better protection to domestic workers, but the domestic workers who mostly live in the house of their foreign employers (including migrant workers such as in this case), and thus often cannot get in and out of the house of their employers freely, are not able to access the protection mechanisms of the State. They also have limited ability to access non-governmental organizations that can facilitate their access to the justice system.

 Most domestic workers can access the complaint mechanisms only after they are able to escape from the house of their employers. Apart from violation of their rights in work, many migrant workers are subjected to physical and psychological abuses that often cause lifelong damages. The Migrant Working Group, Network of Domestic Workers in Thailand and undersigned organizations have the following recommendations to make;

 1. The United Nations and superior officers of Dr. Yonas Tegegn should promptly investigate the incident and propose sanctions according to the UN procedure, if he is found guilty as alleged.

2. The United Nations should consider to develop a Code of Conduct as a tool for internal control of staff in the organization and to set out procedures for conducting a transparent investigation in to such cases. Punishments for those found to have violated the Code of Conduct must be clearly spelled out.

3. Competent authorities should promptly investigate the case and to bring to justice the perpetrators and to ensure strict enforcement of the law.

4. The Ministry of Labour should provide protection and assistance to the complainant as provided for by the law.

5. The Ministry of Social Development and Human Security should act to protect and assist employees who are victims of human trafficking.

 6. The Thai government should consider signing the C189 Convention concerning Decent Work for Domestic Workers to expand the protection available to employees beyond receiving wages or other social benefits. Measures must be meted out to ensure that domestic workers are protected against violation, intimidation, and all forms of violence. By signing the ILO Convention, Thailand shall have more legal tools to prevent and protect domestic workers from any violence apart from the protection provided for in the Ministerial Regulation for the protection of domestic workers in non-business residence no. 14/2011 and issued invoking the 1998 Labour Protection Act and to minimize discrimination against the rights of the domestic workers.

7. The Thai government should require that an employer with a domestic worker aged from 15 to 18 years send a list of their child employees to the labour inspection officer. This will ensure that an employer with a child worker do not exploit and abuse them.

8. The government should consider to set out the number of working hours appropriate to a domestic worker and they should be allowed to choose whether they want to live in the house with their employers or not. It will ensure their freedom of movement and their access to rights protection mechanisms.

9. Improve the mechanism of Labour Inspectors by allowing them to have better access to the residence of the employers employing domestic workers. There should be mechanisms that protect the labour inspector from being accused of trespassing in private property.

10. An effort should be made to develop quality of life and welfare of the domestic workers by revising the Social Security Act. Workmen’s Compensation Fund, and labour relations law. It should enable an employee to have better access to the Social Security Fund and compensation, similar to employees in business enterprises. It should give an opportunity for the domestic workers to get organized and negotiate with the employers to ensure protection of their employees.

วันที่ 3 เมษายน 2558 เมื่อเวลาประมาณ 11.00 น.ผู้แทนหน่วยรักษาความปลอดภัยของสำนักงานองค์การสหประชาชาติและ Dr.Mukta Sharma เจ้าหน้าที่ฝ่ายเทคนิค ขององค์การอนามัยโลก ประจำประเทศไทย ได้เป็นตัวแทนรับหนังสือเปิดผนึก เพื่อเรียกร้องให้สำนักงานองค์การสหประชาชาติทำการสืบสวนสอบสวนกรณีการละมิดสิทธิของลูกจ้างทำงานบ้านที่ทำงานให้กับผู้แทนองค์กรอนามัยโลกประจำประเทศไทย

ทาง Dr.Mukta ได้แจ้งกับตัวแทนเครือข่ายลูกจ้างทำงานบ้านในประเทศไทยและผู้สื่อข่าวว่า

"องค์การอนามัยโลกตระหนักถึงข้อกล่าวที่ปรากฎอยู่ในสื่อ ในกรณีที่เกี่ยวข้องกับเรื่องส่วนตัวของเจ้าหน้าที่องค์การอนามัยโลก ประจำประเทศไทยกับบุคคลที่ทำงานอยู่ในที่พักอาศัยของเจ้าหน้าที่ท่านนั้น

องค์การอนามัยโลกได้ดำเนินการอย่างจริงจังต่อข้อกล่าวหาดังกล่าวและได้ทำการตรวจสอบตามมาตรการภายในขององค์กร"

นอกจากนี้ยังได้ตอบข้อคำถามจากนักข่าวในประเด็นด้านการคุ้มครองทางการฑูต ว่า

"ในสถานะข้าราชการพลเรือนขององค์กรระหว่างประเทศ เจ้าหน้าที่และพนักงานองค์การอนามัยโลก ได้รับความคุ้มครองทางการฑูตบางส่วน เพื่ออำนวยความสะดวกในการปฏิบัติงานของเจ้าหน้าที่ตามที่ได้รับมอบหมาย

อย่างไรก็ตาม องค์การอนามัยโลกสามารถยกเลิกความคุ้มครองดังกล่าว ซึ่งอาจขัดขวางการอำนวยความยุติธรรมอย่างเหมาะสมได้ ตามคำร้องขอของรัฐบาล"

เรื่อง ขอให้เร่งรัดการสืบสวนสอบสวนกรณีการละเมิดสิทธิลูกจ้างทำงานบ้านชาวเอธิโอเปียและข้อเสนอในการคุ้มครองลูกจ้างทำงานบ้าน

ตามที่ปรากฎเป็นข่าวหน้าบีบีซีไทย ลงวันที่ 1 เมษายน 2558 ระบุว่า นายแพทย์โยนัส เทกเก้น ผู้แทนองค์การอนามัยโลกประจำประเทศไทยและภรรยา ได้ถูกลูกจ้างทำงานบ้านชาวเอธิโอเปีย ที่ได้ติดตามมาทำงานบ้านให้แก่นายแพทย์โยนัส และครอบครัว แจ้งความกล่าวโทษเป็นคดีอาญา 5 ข้อหา ซึ่งเกี่ยวข้องกับความผิดด้านเสรีภาพ กักขังหน่วงเหนี่ยว ยักยอกทรัพย์ การนำคนลงมาเป็นทาสและการค้ามนุษย์ สืบเนื่องจากเมื่อลูกจ้างทำงานบ้านได้ทำงานให้กับนายแพทย์โยนัสและครอบครัวแล้ว ได้มีการละเมิดสิทธิและศักดิศรีความเป็นมนุษย์ลูกจ้าง อาทิ ถูกยึดหนังสือเดินทางอันเป็นทรัพย์สินของลูกจ้าง มิได้มีการจ่ายค่าตอบแทนลูกจ้าง และยังถูกทำร้ายร่างกายหรือถูกกักบริเวณ เมื่อทำงานไม่เป็นที่พอใจ ลูกจ้างทำงานโดยไม่มีวันหยุด ให้นอนนอกตัวบ้านกับสุนัข โดยไม่มีพัดลมหรือแม้กระทั่งมุ้ง ให้รับประทานอาหารเพียงข้าวเปล่า รวมทั้งข่มขู่ทำให้ลูกจ้างมีความหวาดกลัวต่อการกระทำของฝ่ายนายจ้างที่เป็นบุคคลมีตำแหน่งและชื่อเสียงในสังคม

กรณีที่เกิดขึ้นนี้นับว่าเป็นกรณีศึกษาสำหรับลูกจ้างทำงานบ้านในประเทศไทย ซึ่งปัจจุบันมีการคาดการณ์ว่ามีลูกจ้างทำงานบ้านในประเทศไทยประมาณ 300,000 คน รวมถึงลูกจ้างทำงานบ้านที่เป็นแรงงานข้ามชาติด้วยที่มีข้อจำกัดด้านการสื่อสารและการเข้าถึงกลไกการคุ้มครองสิทธิมนุษยชนของภาครัฐและภาคเอกชน

ที่ถึงแม้รัฐบาลไทยจะได้มีความพยายามในการปรับปรุงแก้ไขกฎหมายเพื่อให้มีการคุ้มครองลูกจ้างทำงานบ้านมากขึ้น แต่ลูกจ้างทำงานบ้านที่อาศัยอยู่กับนายจ้างโดยส่วนใหญ่ (โดยเฉพาะแรงงานข้ามชาติ อย่างเช่นกรณีดังกล่าว) มักจะอยู่ในสถานการณ์ที่ไม่สามารถเดินทาง เข้า-ออกบ้านพักของนายจ้างได้อย่างอิสระ  ลูกจ้างส่วนใหญ่ที่ขอรับการช่วยเหลือกรณีการถูกละเมิดสิทธิมักจะเกิดขึ้นภายหลังจากที่ตนสามารถหลบหนีออกมาจากบ้านพักของนายจ้างได้ นอกจากลูกจ้างทำงานบ้านจะถูกละเมิดสิทธิตามกฎหมายแล้ว ลูกจ้างหลายรายยังได้รับผลกระทบจากทำร้ายร่างกายและมีบาดแผลทางจิตใจที่ไม่สามารถประเมินได้ว่าลูกจ้างจะพ้นภาวะความหวาดกลัวหรือฝันร้ายจากเหตุการณ์ที่เกิดขึ้นได้อย่างไร เครือข่ายประชากรข้ามชาติ เครือข่ายลูกจ้างทำงานบ้านในประเทศไทย  และองค์กรแนบท้าย จึงขอเรียกร้องและมีข้อเสนอแนะเร่งด่วนดังนี้

 1.         ขอให้องค์การสหประชาชติ และผู้บังคับบัญชาของนายแพทย์โยนัส เทกเก้น เร่งทำการสืบสวนต่อเหตุการณ์ที่เกิดขึ้น และให้มีมาตรการลงโทษตามระเบียบขององค์การรสหประชาชาติ หากพบว่ามีการกระทำผิดตามข้อกล่าวหา

2.         องค์การสหประชาชาติ ควรพิจารณาพัฒนาประมวลจริยธรรม (Code of conduct ) เพื่อเป็นเครื่องมือในการควบคุมตรวจสอบภายในของเจ้าหน้าที่ในองค์กรและกำหนดมาตรการในการสืบสวน สอบสวนอย่างโปร่งในและตรวจสอบได้ พร้อมทั้งกำหนดบทลงโทษสำหรับผู้ที่ไม่ปฏิบัติตามประมวลจริยธรรมอย่างชัดเจน

3.           ขอให้เจ้าหน้าที่รัฐที่มีอำนาจตามกฎหมาย เร่งสืบสวนสอบสวนนำตัวผู้กระทำความผิดและผู้ที่เกี่ยวข้องกับการกระทำความผิดเข้าสู่กระบวนการยุติธรรมโดยไม่ชักช้า และบังคับใช้กฎหมายอย่างเคร่งครัด

4.           ขอให้กระทรวงแรงงานพิจารณาดำเนินการเพื่อให้ลูกจ้างได้รับการคุ้มครองและช่วยเหลือตามสิทธิที่กำหนดไว้ในกฎหมาย

5.           ขอให้กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ดำเนินการคุ้มครองและช่วยเหลือลูกจ้างในฐานะเหยื่อของการค้ามนุษย์  

6.         ขอเรียกร้องให้รัฐบาลไทย เร่งพิจารณาลงนามในอนุสัญญาขององค์กรแรงงานระหว่างประเทศ ฉบับที่ 189 ว่าด้วยเรื่องงานที่มีคุณค่าสำหรับลูกจ้างทำงานบ้าน เพื่อขยายการคุ้มครองสิทธิของลูกจ้างให้นอกเหนือไปจากสิทธิในการได้รับค่าจ้างหรือสวัสดิการเนื่องมาจากการทำงานต่างๆ กล่าวคือ การกำหนดให้ต้องมีมาตรการต่างๆเพื่อให้ลูกจ้างทำงานบ้านได้รับการคุ้มครองจากการล่วงละเมิด การคุกคาม และความรุนแรงในทุกรูปแบบ ซึ่งหากรัฐไทย ลงนามในอนุสัญญาฉบับดังกล่าวนี้ ก็จะสามารถทำให้มีเครื่องมือทางกฎหมายเพิ่มขึ้นในการป้องกันและคุ้มครองมิให้ลูกจ้างทำงานบ้านจากภัยความรุนแรงต่างๆนอกเหนือจากการคุ้มครองที่บัญญัติไว้ในกฎกระทรวงคุ้มครองลูกจ้างทำงานบ้านอันมิได้มีการประกอบธุรกิจรวมอยู่ด้วย ฉบับที่ 14 พ.ศ.2554 ออกตามพระราชบัญญัติคุ้มครองแรงงาน พ.ศ.2541 รวมทั้งยังช่วยลดการเลือกปฏิบัติต่อสิทธิของลูกจ้างทำงานบ้าน

7.         ขอให้รัฐบาลไทย กำหนดให้นายจ้างที่มีลูกจ้างเด็กทำงานบ้านที่อายุ 15 ปีขึ้นไปแต่ไม่เกิน 18 ปี ส่งรายชื่อลูกจ้างเด็กแก่พนักงานตรวจแรงงาน เพื่อป้องกันมิให้มีการนายจ้างให้ลูกจ้างทำงานบ้านที่เป็นเด็ก ทำงานในชั่วโมงการทำงาน และงานที่ทำอย่างเหมาะสม

8.         ขอให้รัฐบาลพิจารณา        ปรับปรุง กำหนดให้มีการจัดทำชั่วโมงการทำงานที่เหมาะสมกับลูกจ้างทำงานบ้าน และให้ลูกจ้างทำงานบ้านมีสิทธิเลือกในการที่จะพักหรืออาศัยอยู่ในบ้านพักของนายจ้างหรือไม่ก็ได้เพื่อสนับสนุนให้ลูกจ้างทำงานบ้านมีเสรีภาพในการเคลื่อนย้ายและเปิดโอกาสให้กลไกการคุ้มครองสิทธิสามารถเข้าถึงตัวลูกจ้างทำงานบ้านได้มากขึ้น

9.         ปรับปรุงกลไกการทำงานของการพนักงานตรวจแรงงานเพื่อให้พนักงานตรวจแรงงานสามารถเข้าถึงสถานที่พักของนายจ้างที่มีการจ้างลูกจ้างทำงานบ้านนั้นอยู่ได้มากขึ้น และป้องกันการปฏิบัติหน้าที่โดยชอบของพนักงานตรวจแรงงานมิให้ถูกกล่าวหาว่าบุกรุกในที่รโหฐาน

10.   ยกระดับคุณภาพชีวิตและสวัสดิการของลูกจ้างทำงานบ้าน โดยการปรับปรุงกฎหมายประกันสังคม กฎหมายเงินทดแทน และกฎหมายแรงงานสัมพันธ์ เพื่อทำให้ลูกจ้างทำงานบ้าน เข้าถึงประโยชน์จากกองทุนประกันสังคมและเงินทดแทน เช่นเดียวกันกับลูกจ้างในภาคกิจการที่ประกอบธุรกิจรวมอยู่ด้วย และเพื่อสร้างโอกาสให้ลูกจ้าง ทำงานบ้านสามารถรวมกลุ่มและเจรจาต่อรองกับนายจ้าง เพื่อให้เกิดการคุ้มครองลูกจ้างอย่างเป็นธรรมมากขึ้น
